GENERAL CONDITIONS OF SALE

    1. By placing an order on the online store www.papee.it, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below .
    2. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance, even partial, of an order. In the event of unexpected unavailability of the goods and failure to accept the order, no charge will be made to the Customer.

PURCHASE METHODS

    3. Correct receipt of the order is confirmed by the papee system by means of a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the Date and Time of the order and an "Order Number", to be used in any further communication with the papee system.
    4. It is the Customer's responsibility to register with the correct data and keep these data updated using the access credentials.

TERMS OF PAYMENT

    5. Amazon Pay The purchase of goods is provided with the automatic payment method Amazon Pay through which you can also use your credit cards (Mastercard, Visa, Visa Electron, Postepay, Lottomaticard, American Express etc..). The transaction with Amazon Pay takes place through the electronic system of the www.amazon.com portal which uses the secure amazon.com server; at no time during the purchase procedure is the electronic system of the portal www.amazon.com and no member of the staff able to know the Customer's credit card number, which is provided by the Customer to the Secure Server of the Amazon Pay Institute on a protected and encrypted internet connection according to the current standards of the online payments market.
    5.1 Credit Card (Visa, Mastercard, Amex) The purchase of goods is also available with automatic payment methods via Shopify Payments in which you can also use your credit cards (Mastercard, Visa and Amex). The transaction with Shopify Payments takes place through the electronic system of the portal www.shopify.com which uses the secure server of shopify.com; at no time during the purchase procedure is the electronic system of the shopify.com portal and no member of the staff able to know the Customer's credit card number, which is provided by the Customer to the Shopify Secure Server on a protected and encrypted according to current standards of the online payments market.
    5.2 Bank Transfer The purchase of goods is also available with payment methods via bank transfer. The transaction, order processing and shipping via bank transfer payment is processed within a maximum of 48 hours from receipt of the bank transfer.
    5.3 Google Pay & Apple Pay The purchase of goods is also possible with automatic payment methods via Google Pay & Apple Pay in which you can also use your prepaid cards (Postepay, Postepay Evolution, Mastercard, Visa, Maestro, Lottomaticard, etc. .). The transaction with Google Pay & Apple Pay takes place through the electronic system of the portal www.google.com or www.apple.com which uses the secure server of google.com or apple.com; at no time during the purchase procedure will the electronic system of the google.com or apple.com portal and no member of the staff be able to know the Customer's credit card number, which is provided by the Customer to Google's Secure Server. com or apple.com on a secure and encrypted internet connection according to current standards of the online payments market.
    5.4 SATISPAY: If you buy with Satispay you receive your order immediately and pay using the Satispay payment app. The transaction takes place on a portal external to papee.it managed by the company Satispay Europe SA
    5.5 ALMA PAY: Payment in installments with Alma. Payment in installments/deferred payment is available through our partner Alma. Payment security is guaranteed by Alma and its service providers. All payments are protected by 3D Secure.
    Amount of P2X purchases: Only purchases between €50 and €2,000 are eligible for payment with Alma. P3X : Only purchases between €50 and €2,000 are eligible for payment with Alma. P4X : Only purchases between €50 and €2,000 are eligible for payment with Alma.
    Commissions By paying in installments with Alma the customer does not pay any commissions. Alma is an online payment manager and issues an electronic certificate which will be considered proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the Civil Code. Cancellation Any termination of the TOS between the Seller and the customer will result in the termination of the TOS between Alma and the customer.
    6. Currency All amounts displayed on papee are expressed in Euros and include 22% VAT, which is the reference currency.

DELIVERY METHODS AND COSTS

    7. Papee accepts orders only for delivery within Italian territory.
    8. Delivery costs are explicitly highlighted when placing the order. Some promotions may offer discounts equal to shipping costs for orders above a certain value determined by the offer itself. Payment for the goods by the Customer will take place using the Amazon Pay, Credit Card, Bank Transfer, Google Pay & Apple Pay, Clearpay, Alma Pay, Satispay methods, the charge on the credit card will be applied by Papee Srls or by companies third parties who manage the payment portals on which Papee Srls relies (Owner papee.it), operator of the integrated Papee platform. Nothing more is owed by the Customer than the order total.
    9. Order processing times are specified on the product page and can vary from a minimum of 48 hours to a maximum of 7 working days. No responsibility can be attributed to Papee in the event of a delay in the delivery of what was ordered by the couriers.
    10. Upon delivery of the goods by the courier, the Customer is required to check: that the number of packages delivered corresponds to what is indicated in the transport document; that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials (adhesive tape or metal straps). Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately reported by affixing the writing "INTEGRITY CHECK RESERVE" on the courier's proof of delivery. Once the courier document has been signed, the Customer will not be able to make any objections regarding the external characteristics of what was delivered. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 48 working hours of delivery, according to the methods set out in this document.
    11. In the event of failure to collect the material in stock at the courier's warehouses within 3 working days due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be automatically canceled and the customer will be shipping costs and shipping storage costs at the location of the courier chosen during the order will be charged.

RIGHT OF WITHDRAWAL

    12. Pursuant to art. 5 DL 185/1999, if the customer is a consumer, he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, without prejudice to what is indicated in point 15 below.
    13. To exercise this right, the customer must send papee a communication to this effect, within 14 working days from the date of receipt of the goods. This communication must be sent by certified email, addressed to papeesrls@pec.it Once the aforementioned notice of withdrawal has been received, papee will quickly communicate to the customer the instructions on how to return the goods which must reach papee within 3 days of authorization.
    14. right of withdrawal is in any case subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product; the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, placing it in a second box; In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided; in accordance with the law, the shipping costs relating to the return of the goods are borne by the customer; the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the customer; in the event of damage to the goods during transport, papee will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain a refund of the value of the property (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request; papee is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments (Free Priority Mail Shipments).
    15. Without prejudice to any restoration costs for confirmed damage to the original packaging, Papee will reimburse the customer the entire amount already paid, net of shipping costs incurred, within 14 days of the return of the goods, through a refund procedure. the amount debited to the Amazon Pay account, Google Pay & Apple Pay account, Shopify Payments account, Clearpay, Alma Pay, Satispay account or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code of the invoice holder).
    16. The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Papee ascertains: the lack of the external packaging and/or the original internal packaging; the absence of integral elements of the product; damage to the product for reasons other than its transport. In the event of forfeiture of the right of withdrawal, Papee will return the purchased goods to the sender, charging the shipping costs to the sender.

PRIVACY

    17. The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer and will under no circumstances and for any reason be transferred to third parties. papee guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 06.30.03. The data controller is Papee Srls, Via Capri 2 – 80026 Casoria (NA).

COMPLAINTS

    18. Any complaints must be addressed to Papee Srls, Via Capri 2 – 80026 Casoria (NA) or via certified email to papeesrls@pec.it

APPLICABLE LAW

    19. The sales contract between the Customer and Papee Srls is intended to be concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Nola (NA).

DISPUTE RESOLUTION

Amicable settlement of disputes
    20. Users can report any disputes to the Owner, who will try to resolve them amicably.

    Although the right of Users to bring legal action remains unaffected, in the event of disputes relating to the use of this Application or the Service, Users are asked to contact the Owner at the contact details indicated in this document.

    The User can address a complaint to the Owner's email address indicated in this document, including a brief description and, if applicable, the details of the order, purchase or account affected.

    The Data Controller will process the request without undue delay and within 21 days of its receipt.

    Consumer dispute resolution platform

    The European Commission has introduced an online platform for alternative dispute resolution that facilitates the out-of-court settlement of disputes relating to and arising from online sales and service contracts.

    Therefore, any European Consumer or one based in Norway, Iceland or Liechtenstein can use this platform to resolve disputes arising from contracts concluded online. The platform is available here .
